                    Delhi High Court Dismisses Plea Of Nokia-Seimens Network, Over BSNL Network Contract Tender
        Last week BSNL after getting clearance from security agencies of Govt. of India started the process of the tender worth $ 6 billion & qualified Huwaie & Erricson companies of China ,& Sweedan.Nokia-Seimens Network company also participated in this bid but disqualified on technical ground. NSN filed petition against this decision in Delhi High Court. Senior Advocate for BSNL during proceeding pointed out that Tenders Challenged by NSN were floated in CHANDIGADH ,MUMBAI, HYDERABAD, KOLKATTA Zones of BSNL & these zones are out of the jurisdiction of Hon'ble High Court Delhi.    Following the Delhi High Court dismissed NSN petition & added company may approach the appropriate High Court which had the jurisdiction over this issue.
         As BSNL is facing capacity crunch across the country, further delay in awarding contract may lead bottle neck situation in expansion. This situation was already faced by BSNL in year 2006. In 2006 year MOTOROLA stayed the process & the progress was delayed by one year, after taking back the petition. Utmost care has to take to BSNL for dealing such cases as BSNL has to lead the telecom market.

Centralized Lawful Interception  Monitoring System

          It is reveled from the sources that, the prime task of telecom ministry is to formulate a centralized agency to monitor the wireless, fixed line, Mobile, Satellite, Internet, International communication Traffic for gathering the intelligence on the back drop of 26/11 incidence. It is understood that Rs. 450 cr. are required to setup this autonomous agency and will be called as centralize Lawful interception Monitoring system .

         In UK and western countries such systems are already operational and in India on the same line this new agency will work. At present Monitoring of telecom traffic is done by different agencies e.g. Police ,CBI ,LIB,Defence Intelligence and a cell from DOT is coordinating with all above agencies separately and the work involved in this process is of repetitive nature, hence to simplify this centralized single agency is needed. This agency will be formulated very soon.

Reforms In Telecom Sector- as UPA-led Govt. will take over the Offices

              As all of us are aware of the fact that mandate to UPA+ has already reach the magic figure & it is expected that the new Govt will start it's functioning from next week. The new spectrum policy & the listing of State owned company BSNL will be definitely on top priority. It is expected that definitely the new Govt. will gear-up the process for auction of 3G spectrum  & the mobile users of India will experience the high speed internet, Video-Conferencing & NGN technology. It is learnt that the CDMA operators expects Shri. RAJA to continue & GSM operators want the ministry to be handled by a Congress. If the portfolio of Telecom Ministry is taken over by Congress it will be easy for them to push the 3G auction & double the floor price of these airwaves to over 4000 crs.as it is demanded by finance ministry.  

             It is understood that UPA will forward the move to set new policies regarding rural-oriented telecom resources & technologies. The new Govt will usher in mobile number portability. BSNL listing is also on cards. The sector can expect a introduction of new spectrum allotment policy. The clear mandate will enable Govt to overcome the opposition from vested interest who are opposed to massive policy changes. Telecom industries are having high expectations from this new Govt.                                 

             It is now a great responsibility on the shoulders of veterans of Trade Unionist to tackle the issues coming through this new policies of listing of BSNL, auction of 3G spectrum, lowering in tariffs, stiff competition, reduction in ADC, Reduction in USO funding, Losses due to provisioning of rural telephony, staff demands & expectations. We all have to have rethink again rejuvenate our strength, determine our goals & change of attitude sincere working UNITY will make us FITTEST TO SURVIVE BSNL & its, Executives.

                                              BSNL gets nod to award deal to Huawei 

               STATE-RUN telecom giant BSNL has overcome opposition from the Intelligence Bureau (IB) and the Defence Ministry, winning a permission to award a lucrative contract for telecom equipment to Chinese company Huawei. A government panel, which included representatives from IB and the Defence Ministry, has endorsed BSNL's position and allowed the company to place order with Huawei for only southern states, as they have no international land borders.    

               Defence Ministry clears deal, as Southern states do not share international borders. The Govt. had set up a panel to examine the participation of foreign companies in BSNL tenders. BSNL had short listed Huawei and Ericsson for its 93-m-line GSM project worth around Rs. 30,000cr. Ericsson was short listed as the lowest bidder for Northern and Eastern regions, while Huawei made the cut for the Western, Eastern and Southern zones. The Government has also set up  a committee, comprising representatives from IB, the Defence Ministry, the department of telecom and intelligence agency RAW ( Research and Analysis Wing ), to examine the issue of participation of foreign companies, particularly with regard to security- related sensitivities, in BSNL tenders.

              The BSNL executive also said that the committee did not open the bids for the Western region for three reasons, Huawei is the only company short listed for this region, but since Western Indian state share sensitive boundaries with Pakistan, the contract cannot be awarded to the Chinese firm. Moreover, Ericsson has been ruled out as it has already been selected for the North and the East. Finally, the panel has not taken a decision on measures that must adopted when awarding contracts, including conditionalities, in sensitive areas, IB had said that BSNL, should not award contracts to Chinese telecom equipment companies, as "these firms were known to have links with the Chinese state  and security apparatus and, therefore, their presence in this critical sector has national security implications a variety of ways.      

              Mumbai :- Telecom service provider MTNL has earmarked a Capex of Rs. 1,725 cr. for the current fiscal year, which will be completely funded through internal accruals. In the recent past, the company has been eyeing opportunities in overseas markets. MTNL, through its international long distance and CDMA service in Mauritius on Friday. It also provides wireless service in Nepal as a part of its JV, United Telecom. " We did not go ahead with the bids for mobile service in Rawanda and Saudi Arabia, as they were very expensive,” said by CMD RSP Sinha, while launching the firm's 3G operations, branded Jadoo, in the city.

                               No Spectrum alloment beyond 6.2 Mhz till DOT finalizes criteria -says S.G. of INDIA
          Shri. Goolam Vahanvali Solicitor General Of India asks Government  not  to give spectrum beyond 6.2 MHz till DOT finalize the criteria. Last year in June 08, a committee is constituted to review all these things. The report of this committee is yet to be approved by competent Authority.
         DOT had sought his opinion on the question as to the scope & effect of TDSAT judgment that the said operators have no vested right to get spectrum beyond 6.2 MHZ. The legal opinion may affect many mobile operators who have applied for the additional spectrums in many circles based on existing sub linked criteria. After approval of committee report a proper effect will be given to TDSAT judgment.

                             DOT Notifies Mobile number portability  to be effective from September 2009

        Notification issued by DOT for mobile number portability (MNP). In first phase the zone one will be under MNP i.e.Maharashtra, Gujrat and four Metros (Mumbai,Delhi,Kolkatta & Chennai) w.e.f. 20th September  2009 and in rest of country it will start from 20th March 2010. Syniverse technologies (Zone-I) & MNP interconnectivity (Zone-II) are the two companies who have been licensed by DOT to carry out the MNP exercise. TRAI will decide all kinds of tariffs related to MNP. Sources revealed that the charges of MNP will be around Rs. 300 per customer and required minimum two days to change the service provider. It is the main activity under the 100 days program of new ministry.

                                                                DOT - Reviewing M & A Guidelines

         DOT sources revealing that a special committee set up to re-evaluate spectrum pricing is also reviewing M & A guidelines. At present the M & A guidelines discourage the merger between two operators holding mobile spectrum. It is the situation arise due to issuance of many licenses & spectrum, as this has fragmented the spectrum space beyond optical limits. Due to this situation a need is generated for formulation of new guidelines, which will boost the merger & transfer between two operators holding mobile spectrum.
        DOT is considering a transfer fee to ensure that the licensee does not make a windfall gain simply by trading his scarce commodity. In this Govt. has to cede it's role as arbitrator. Govt. has to ensure appropriate use of spectrum market & at the same time Govt. will have to accept moderate windfall gains to operators by allowing trading with associated transfer price..
        Before the 120 new licenses were given the average GSM spectrum per operator was 7.4 MHZ. Now this has come down to 5.7 MHZ. As the M & A guidelines fall apart, it is quite clear that INDIA will once again settle at 5 to 6 operators with about 4 pan- India operators & few regional players.

                                                        Be Proactive, Productive, Self-Motivated

        It is a well known fact that a monotonous repetition of same thing leads to boredom. The responsibility to overcome such situation at work place lies with both, the Organization & the individuals. At individual level it is important that one continues to revisit one's role periodically to identify any opportunities for making job larger. From Organizational level Executives who have acquired the necessary skills to perform a particular role effectively & demonstrated sound performance need to be entrusted another role to perform to break the monotonous nature of job & to motivate the Executive. While doing so, one should keep in the mind that, the act of shift should not disturb the class & put the Executive in more difficulties. The management must take the Executive in confidence prior to any change in work place or change in work/job.

        Organization should make maximum use of it's Executives' strength to ensure benefit for organization & for individuals also. It is very important to the Executives that, always he /she should keep Self-Motivated, Proactive & remain in people activities. It is a responsibility of the Executives to take charge of his /her own development as against the out-dated, orthodox, conventional approach & concept, of waiting for the organization to tell him /her to do something ,or to take initiative about it.
         To reignite Passion at work place;
1) Build a good relationship, Meet colleagues, Be Proactive, Be positive
2) Keep warm environment, seek new challenges, Learn new skills,
3) Be constantly engaged, Focus on your work Keep stress-less environment

         You need to be a people person in order to Excel. One need to understand that stress brings failure,& failure brings more stress, this vicious cycle then becomes a recipe for sure-shot disaster. Hence for this only one key - Motivation, the Mantra for stress-free work place environment is to be adopted. Motivation should be the integral part of the success. Under stress-full circumstances it is all the more crucial for the top management to keep the team pumped up in order to manage the stress, for that the utmost requirement is that the top management must be self motivated. If the top management is not motivated enough it can have a negative impact, on organization & on individuals. In the present stiff competition era the management has been frantically working towards cutting in cost, reduction in maintenance cost & meeting the targets. This will stretch & create stress unprecedented &also expected to have unshakable belief can only happen only when the management is motivated in turn they can motivate the Executives. I appeal all of you to be Proactive, Productive, Positive,& Self Motivated.

PMO rejects telecom fee cut

        The Prime ministers office (PMO) has shot down the decision of the communications ministry to slash the license fee for telecom operators with large networks by up to a third, saying the ministry didn’t obtained the cabinets clearance before announcing the cut.

       Last year DOT announced that the proportion of the revenues telecom operator pay as license fee to the Govt.would be cut by 33% from 1 April 2009 if operators services are available in 95% of residential areas in a telecom circle. Intention of this move is to give Rs.2000 crore annual benefit to the Industry.

       Following the PMOs directives, the DOT will recall its notification announcing the reduction in license fee. In a missive to communication ministry, the PMO said that the Telecom Dept.didnot follow the procedure and obtain cabinet clearance prior to the announcement in reduction in fees. It is reliably understood that for this proposal there is a opposition from Dept of Expenditure & Economics affairs of Finance Ministry. DOT in its defense, said the license fee cut was based on TRAI recommendations.

       At present Telcos pay 10% of their revenues as a licenses fee in category A Circles, 8% in B zones & 6% in C zone cities. The license fee cut would not have impacted the exchequer as DOT had planned to reduce Telcos contribution to the USO Fund  for rural telephony, which is paid out of the license fee.

       Currently, all operators pay a flat 5% of their total revenues towards USOF. This means half the license fee of an A circle player goes USOF.while almost 85% of a C circle operators licenses fee goes to fund rural telephony.

        The PMO while admitting that about Rs. 14000 crore remained unutilized in USOF as on Feb 28 this year this amount can be utilized for ambitious plans for subsidizing telecom infrastructure in rural areas.

TELECOM  LICENSE  RENEWAL  MAY  COST  MORE

     COMPANIES providing cellular service may have to shell out sizeable sums to renew their licenses' to continue operating which may be due to expire in the coming years, if a government panel has its way. The panel, which was set up to resolve all spectrum-related issues., has recommended that telecom companies should pay a fee equivalent to the market value of the spectrum they hold at the time of renewal. ost telecom operators had got their licenses in the early 1990s for a 20 year period which is set to expire over the next couple of year.

     Currently, these companies can get a Pab- India license for Rs. 1,651 crore, a rate determined in 2001. India is divided into 22 circles and each of them has a different entry fee, and the total adds up to this amount. The panel has proposed three possible methods to determine the fee, which operators will have to pay to renewal their licenses. It has also added that if the company refuse to pay the renewals fee , the  airwaves it holds will be auctioned by the government.

     While all major operators refuse to comment, since the panel's report is yet to be made official, some of them said they would oppose any proposal that would result in high renewal fee. Two operators also pointed out that in most countries license extension was automatic. The panel's recommendations from a sharp departure from the views expressed by both the communications ministry and the telecom regulator Trai. Last year, DOT had proposed that telcos pay about Rs. 825.5 crore for extending their license tenure by 10 years. but this was rejected by Trai who wanted to make the renewal automatic.

    DOT had arrived at this figure as follows; The entry fee of Rs. 1,651 crore multiplied by 10 ( the number of years for which the license needs to be extended), and the total is divided by 20 ( the number of years for which the telco can use its spectrum)

    It is reported by the Sources that Dept. of Telecom is busy in preparation of the agenda ( 100 days program) for the new Telecom Minister who is expected to take Office by May 3rd week. The ground work for the work agenda is in process.

     According to Senior Officials from DOT it is learnt that, 4 biggies in Telecom sector in India have been invited for submission of their views & list of issues pertaining to Telecom Sector by end of may 10 which these biggies believe need to be addressed by DOT urgently.

    Sources reveal that already DOT is working on different Critical issues like spectrum allocation, its pricing & preparing a comprehensive agenda. DOT this time seems very proactive towards the issues in Telecom Industries raised by the biggies in Telecom. Department has also engaged some of largest multinationals providing services under different Licenses to lay out their issues & priorities. Between two sets of these companies Govt. expects to cover all the issues & inputs I industries for consumer voice market & data marketing Internet, B/Band & enterprises segment.

MEETING WITH HON. CGMT MH CIRCLE: The Dist President Com. S. P. Sonawane, Com. Vivek Wankhede, Dist Sec of SNEA (I), Com. V.R. Deshpande, Dist Sec, Com. C.M. Saste Org. Sec, Com. V. P. Kulkarni C/S AIBSNLEA and united forum president MH circle Com. A. G. Joshi, met today with the Hon. CGMT, MH, Circle on united forum platform on the very burning issue of the transfer of JTO’s from urban to rural for 2nd tenure to rural.

    The leaders expressed their view about the changed scenario and need for review of the stand taken by Hon. CGMT in July 2007. The corporate office guidelines issued in 2004 has lost its sanctity with the period of time and penetration of new tech services in rural. The Hon. CGMT was very considerate to listen to the views of leaders and after going through in details of the issue and transfer policy was completely convinced on the issue. He spoke with Shri. Mishra, GM (Pers) and Shri. Dey GM(Pers-IV) on their mobile at New Delhi and enquired about the details of the orders issued by corporate office to which Shri Mishra responded that the issue has been already taken by the General secretaries of both the associations and the matter is under serious consideration with CMD and Director (HR). Since the director (HR) in out of country for a week time were not available.  He discussed the issue thoroughly with Shri. Jayraman, GM (admin) and the leaders on the latest transfer policy guidelines issued in May 08/ August 08, he called up PGMT, Pune to held up the transfer orders till the clarification is issued form the corporate office.

    This issue of barring of STD facility on RFSTC (landline) of the executivesof Pune was also discussed. He called up Shri. Sawarkar, DGM, to discuss the issue in details with him on Monday. Both the issues will be discussed in the forthcoming management meeting scheduled on 7th and 8th May 08.

    The meeting lasted for more than one and half hours. The Hon. CGMT was kind and considerate enough to tackle the issue in a very positive manner. We appreciate his sincere and serious efforts to resolve the issues raised by the leaders.  <<<Click Here for Letter>>>

RCOM NET DOWN 3.3% ON EXPANSION COSTS-LOWER USAGE

    Hit by high expansion costs and lower minutes of use on its network, Reliance Communications has reported a 3.3% drop in net profit despite a growth in subscriber base. The company's cap-ex for the current fiscal is Rs. 10,000 crore, excluding the outlay for 3G and broadband wireless access service.

 BHARTI,ALCATEL-LUCENT IN LANDLINE ALLIANCE

    BHARTI Airtel has entered into a joint venture with Franco- American telecom gear maker Alcatel-Lucent to manage its Landline and Broadband business, expanding its tested strategy of outsourcing technology functions to focus more on marketing and sales.
