    30Nov 2009                                         DOT for secure portability

       The department of telecom (DOT) wants operators to make their network accessible to lawful interception and monitoring (LIM) for thesecurity agencies after they switch to mobile number portability (MNP) mechanism by the end of next month.
       DoT is likely to issue directives soon to all the telecom licensees on putting the subscribers under the LIM even before MNP is activated in the system. MNP is a system that enables subscribers to retain their old number even after they switches service providers, a DOT internal note said. DoT will provide copy of the mobile clearing house (the server on which all the ported numbers and those which are in the process to be ported) to the ministry of home affairs regularly to keep agencies updated on the switch of operators.
           This would help the agencies track and trail any particular target number. In the case of a need, they can approach the operator to release the entire call details even as the number remains the same after switching the operator.
India will introduce MNP on December 31 in metros. MNP will be introduced in two phases — first in the metro cities and the so-called category a telecom zones, and in other areas by March 20.
The regulator TRAI has notified certain charges associated with MNP and said switching charges for users must not exceed Rs 19

                               HC rejects Govt plea on advancing date for spectrum

                  SNEA(I) stand vindicated by Hon'ble High court of Delhi.

    The Delhi High Court today rejected a petition by the government challenging an earlier order quashing a notification for advancing the cut off date for release of 2G spectrum to telecom operators.

   The Telecom Ministry, headed by A Raja, had advanced the date by a week to September 25, 2007 for issuance of licence, a decision that was challenged by Chennai based operator S Tel.

    After losing the case at the single member Bench, the government had moved a Division Bench seeking quashing of the order, which in other words would mean that Telecom Ministry would have to consider applications received till September 31 received for 2G spectrum.

   A Division Bench comprising Chief Justice A P Shah and Justice S Muralidhar dismissed DoT's petition seeking stay over the order of the single member Bench of July 1, 2009.

    The court did not agree with DoT's submission that it had advanced the date to handle the large number of applicants and it was a 'public policy' decision.

    The Division Bench upheld Justice G S Sistani order, who held that DoT could not "arbitrarily fix a cut off date for capping the number for licences bundled startup spectrum" and quashed the press note issued on October 10, 2008.

     The respondent (DoT) has failed to satisfy the court as to how any public interest would be affected in the matter. The impugned press release dated October 10, 2008 is quashed," Justice Sistani said directing DoT to consider Chennai-based S Tel's application to start operations in 16 circles.

    Earlier, the deadline was October 1, 2007. However, in January 2008, the DoT had amended the criteria and said that due to a large number of applications, only requests up to September 25, 2007, would be considered.

   The court's direction had come on a petition filed by Chennai-based S Tel, whose application for licence in 16 circles was turned down as it had applied on September 28, 2007, three days after the cut-off date.

    20 Nov 2009           COLD WAR BETWEEN DOT AND DEFENCE MINISTRY OVER 3G SPECTRUMS

    It is reliably learnt that DOT conveyed to the Defence Ministry to produce proof of their claims that the WIRELESS PLANNING & COORDINATION WING of the Ministry of Communications had reserved and allotted all 6o MHz of 3G in the band 2.1 GHz to the Defence Ministry. As per DOT say only 10 MHz of 60 MHZ is allotted to Armed Forces. The Armed Forces on the other hand pointed out that DOT failed to provide an alternate fiber optic cable network for defence forces in time as specified in MOU is the main reason for non vacation of the airwaves.

       Restoration of HRMS data of JTOs selected as dept outsider from TTA cadre: GS had a brief discussion with GM(Estt) on this important issue. The HRMS data of some TTAs selected as JTOs are deleted by some SSAs. Due to this their pay, leave, EPF account transfer, bonus, past service details etc. is not getting settled. This serious issue has to be resolved immediately, GS told GM(E). GM(E) suggested to have a detailed discussion to resolve  this issue next week.

     JTO(T) to SDE(T) DPC under seniority quota: Association met GM(Pers) and expressed concern over the delay in initiating the DPC process for JTO to SDE. Since the preparation of All India Eligibility list is a lengthy process as gradation particulars has to be obtained from Circles and the provisional All India Eligibility list has to be circulated among the JTOs before initiating DPC process, we requested immediate action. In the earlier meeting GM(Pers) assured action within a week but nothing happened even after two weeks, we informed GM(Pers). GM(Pers) assured prompt action. JTOs of 1994 year having 13 years of service as JTO are waiting for their first promotion.

     Training programme of SDE(C/E) replacing the Accounts Examination: Association further discussed the issue with GM(Civil), ALTTC, Gaziabad. GM(C) informed that since  the training programmes till the month of March is already finalised at announced, the training for both the batches are sheduled for the month of April and got the approval also. Earlier association had a detailed discussion on this matter with GM(Trg), BSNL CO and requested his personel intervention. Meanwhile conducting the training earlier at RTTC, Nagpur will also be explored.

        17 Nov 2009    FOREIGN TELECOM. COMPANIES GAVE A MISSED CALL TO PRE BID CONFERENCE OF 3G AUCTION              

                           Yesterday Ministry of Communication hold the pre bid conference of auction of 3G.It is observed that most of the foreign companies preferred themselves to keep away from this conference. This pre bid conference was arranged to provide clarity about the 3G auction to the mobile operators but it is understood by the sources that Govt. could not clarify the doubts raised by the present operators, hence the said meeting is again going to be held next month. Even though the foreign telcos   showed their NO INTEREST in investing in 3G auction the existing 13 Indian operators may generate revenue tuned to 25000-35000 crores to  the Indian Budget and Govt  is expecting to earn the revenue from this auction.

On our request, Director(HRD) has spoken to CGM/J&K to initiate immediate action for early listing of the case. Further GS also spoken to Sri. N. N. Gupta, CGM, J&K Circle on 10.09.2009 and requested him to use his good office for the early listing and disposal of the case.


      16 Nov 2009             PRE BID CONFERENCE FOR AUCTION OF 3G   SPECTRUM

           On 16th NOV. 2009, To offer high end services to the customers 3G is the MANTRA, hence the DOT is making all efforts to make auction of this 3G spectrum & part of this process is to call a pre bid meet of all interested & eligible parties. Communication ministry will seek to clarify & address all the quires regarding the spectrum in all circles. Prior to start the bidding DOT will display the list, the slots allotted to different circles etc. The  information memorandum (IM) adds that only GSM players are eligible in the states of H.P. & U.P.(W) further IM states that CDMA operators there is no 3G AIRWAVES for auction in Delhi, Mumbai, Maharashtra, Andhra Pradesh, Punjab & Rajasthan Circles.

     Meeting with Director(HRD): It is reported that, GS along with AGSs, Com Khan and Com Sebstian, met Director(HRD) and discussed the following issues.   

DPC from JTO to SDE under 67 % quota : The SNEA CHQ  Leaders strongly urged that  the DPC should be immediately notified for the vacancy years 2008-09 and 2009-10 and necessary action be initiated in this regard.   Director(HRD) who assured to this delegation that he would direct concerned officers to initiate appropriate action in this direction .

     LDCE from JTO to SDE: The LDCE from JTO to SDE for about 4400 TES Gr B vacancies should be immediately notified against the vacancy years 2006-07 and 2007-08. The resultant vacancies for the year 2008-09 may also be taken into account before notifying the exam, G.S. & his team requested Director(HRD). Favourable consideration of their request and early notification of the examination was assured.

       Regularization of adhoc STS officers: The process of regularization of about 2300 existing adhoc STS officers  which is stalled due to legal reasons needs to be expedited as early as possible. SNEACHQ informed Director(HRD) that Assciation is not averse to any kind of arrangement that helps in regularization of adhoc STS officers at the earliest. Director(HRD) informed that BSNL has send the legal opinion that it has received from its legal counsel representing BSNL in Supreme Court to DOT for taking a final view on the matter.

       Promotion from STS regular to JAG: Immediate steps may be taken to initiate the process for   promotion of recently regularized 280 STS officers to JAG. Director(HRD) informed that this process is expected to be completed shortly and necessary action to promote these regular STS officers to JAG has already started.

       DPC from SDE to Adhoc STS: SNEA CHQ requested Director(HRD) to direct CGM/J&K to take appropriate action to ensure early listing of the case by BSNL in J&K High Court so that the interim stay granted by High Court is vacated as soon as possible by submission of facts before Hon’ble High Court. Director(HRD) spoke to CGM/J&K to initiate immediate action for early listing of the case to enable BSNL Hqs to issue promotion orders from TES Gr B to adhoc STS as early as possible.

       Referendum of Associations: Dir (HRD) informed that this issue is under active consideration of BSNL management since the committee constituted to finalize the modalities for holding the referendum has submitted its report.

        ACP of Civil & Electrical: SNEA CHQ informed Director(HRD) that since the committee constituted for the purpose of deciding the issue for Civil/Electrical etc has already finalized and submitted its report It is understood that it is positive and addresses the issue appropriately, there is no point in linking the issue to other cadres and thus unnecessarily delaying it. G.S. & his team impressed upon the  Director(HRD) to get the necessary orders to remove the anomaly in respect of Civil/Electrical etc issued at the earliest, and were assured by director(HRD) that he would discuss the issue further with the concerned officers.

       Continuation in CDA scales till the date of promotion/retirement: The pension of all the persons who have availed this option is not being settled by Jt.CCAs. GM (Est.) has already asked for the requisite information from the circles but no major circle has provided the same. SNEA CHQ requested Dir (HRD) to kindly issue DO letters to CGMs to send the information at the earliest. Dir (HRD) asked SNEAto remind the same in the next week as GM (Est.) will be available next week only.

                                               Govt’s Telecom Revenue Dips 

            The Govt’s Telecom Revenue for the first time shows the dip in this first half of fiscal year 09-10. Even though In this first half 80 million new customers added still there is a dip. This will make the Govt. difficult to make cut in levies despite a strong demand of cut in levies by the Telecom Industry.

       According to data compiled sector regulator TRAI, the industry’s gross revenues – excluding fixes lines – for the quarter ended September 2009 was Rs. 38,755 crore. This was lower than the sector’s revenues in December 2008. When it recorded Rs. 39,408 crore despite having 125 million fewer customers than. Despite a record addition of just under 45 million new customers, the highest ever in a quarter in the January-March 2009 period, the sector’s revenues increased only marginally to Rs. 40,445 crore when compared to the corresponding quarter. Since then, it has been on a downward spiral. It fell to Rs. 39,108 crore and Rs. 38,755 crore in the quarter ended June and September 2009, respectively.  

         As present, telcos pay between 25% and 30% of their annual revenues to the government towards different forms of levies. These include license fee, spectrum usage charges, service taxes and other related levies, education cases while another 5% of their revenues goes towards the Universal Service Obligation Fund, which is used to fund rural telephony. Therefore, any reduction in the Telcos’ revenues translates into a direct fall in the contribution of this sector to the government’s kitty.

              Hon. High Court of Andhra Pradesh which stayed the DGM recruitment in W.P. 21523/2009 on technical grounds earlier based on the arguments put forth by  Advocate was vacated, when the administration approached on Jurisdiction. Subsequently a case was filed by our A.P. SNEA (I) Comrades in Hon CAT Hyderabad vide OA SR 2872 /2009, which will be heard in the early next week.

  05 Nov 2009                                   Govt to raise public holding in PSUs to 10%

                   The government today decided that all listed central public sector enterprises (CPSEs) would increase the public holding to 10 per cent and all unlisted profitable state-owned entities should go public.
                "All profitable listed CPSEs should need the mandatory listing of 10 per cent public ownership," Home Minister P Chidambaram told reporters after the meeting of Cabinet Committee of Economic Affairs here.The government has also decided that all unlisted CPSEs, which have made profit in the past 3 years and have a positive net worth should get listed on stock exchanges, he said, adding that CPSEs would enter the market at "appropriate" time.The decision will have a bearing on mineral major NMDC and MMTC as the public shareholding in these companies is 1.62 per cent and 0.67 per cent respectively.

               As per SEBI regulation, listed companies are required to divest a minimum of 10 per cent of the equity to the public.The minister further said the proceeds of the disinvestment would straight away go to meeting the capital expenditure of the government's social sector programmes, without being routed through National Investment Fund (NIF).In pursuance of its disinvestment programme, the government had offloaded its stake in Oil India Ltd and NHPC in the current fiscal. It has also unveiled plans to reduce its shareholding in NTPC, Sutluj Jal Vidyut Nigam and Rural Electrification Corporation

     I-T Dept. issues fresh show cause to Vodafone  (E.T Bureau @ Delhi) The Income-tax department on Friday issued a detailed show cause notice to the Netherland incorporated Vodafone International Holdings as to why it should not be treated as a defaulter for not deducting tax at source on the $ 11.2 billion paid to Hutchison Telecommunications International for the acquisition of Hutch Essar in 2007.   

DOT Seek Cut In Levy For Big Cos, No Fee For Landline Services

                  As per E T report the Top Telecom players such as Bharti Airtel, Vodafone, Essar, Reliance Communications and state-owned BSNL could benefit from a Government move to speed up a relief package that will ease some burden off the sector saddled with shrinking revenues and margins triggered by a raging tariff war. The department of Telecom (DOT) will seek a fast- track approval from the finance ministry to slash the annual license fee by up to a third for Telecom Operators with large network presence. It will also propose to the finance ministry that all license fee by exempted for landline service.
